Artly Ally: Terms & Conditions

Welcome to Artly Ally (the "App"), developed and operated by Wonder Peddler ("we," "us," or "our").

Please read these Terms and Conditions ("Terms") carefully before downloading, purchasing, or using Artly Ally. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you are a parent, legal guardian, or caregiver allowing a minor or child to use the App, you agree to these Terms on behalf of yourself and your child.

1. Eligibility, Parental Consent & Responsibility

Adult Authorization: The purchase, download, installation, and setup of the App must be performed by an adult (parent, legal guardian, or authorized caregiver who is at least 18 years of age or the age of majority in your jurisdiction).

Supervision of Minors: While the drawing canvas and tracing activities are designed for children, tracing creation, audio recording, settings management, and any external file export or sharing must be conducted or directly supervised by an adult.

Parental Agreement: By permitting a child to use the App, you accept full legal and financial responsibility for their actions and use of the App.

2. Nature of the App & Local Storage Architecture

Local Media Storage Architecture: Artly Ally is architected to operate with a local-first media model. All user creations, including drawings, custom tracings, animations, and voice/audio snippets, are processed and stored strictly on your local device storage.

Technical Cloud Infrastructure & Remote Configuration: While user artwork and audio files remain strictly local on your device, the App may periodically connect to secure cloud infrastructure (such as Google Firebase Remote Config) to retrieve technical app configurations, system parameters, security patches, and feature availability flags.

No Cloud Media Hosting: Wonder Peddler does not host, upload, collect, or store your drawings, tracings, or audio recordings from the App on external servers or cloud databases.

Data Backup Responsibility: Because Wonder Peddler does not store or maintain copies of your content, we have no technical means to restore lost, deleted, or corrupted files. You are solely responsible for creating regular backups of your device's data via your operating system’s backup mechanisms (such as Apple iCloud or Google Drive).

Exclusion of Liability for Local Data Loss: To the fullest extent permitted by applicable law, Wonder Peddler shall not be liable for any loss, corruption, or unintentional deletion of your artwork, tracings, or audio recordings resulting from device failure, software updates, app data clearing, app uninstallation, factory resets, device theft, or hardware damage.

3. User-Generated Content & Audio Recordings

User Ownership: You and your family retain full intellectual property ownership of the drawings, custom tracings, and audio recordings you create within the App.

Creator Responsibility for Content & Audio: The App enables parents, caregivers, and educators to create custom tracings and record accompanying voice/audio guidance and celebratory messages. You represent and warrant that:

Any drawing, image, text, or audio note recorded or incorporated into a tracing is appropriate, lawful, and safe for children.

You possess all necessary rights and permissions to record, use, and share any voice notes, music, or media.

Your recordings and creations do not contain defamatory, offensive, harassing, obscene, hateful, or infringing material.

No Content Moderation: Because the App functions strictly offline and locally without sending your content to our servers, Wonder Peddler does not monitor, review, screen, or moderate user-generated content or audio recordings. Parents and legal guardians bear sole and exclusive responsibility for the appropriateness of content accessible on their devices.

4. Parental Controls, Lock PIN, and Biometrics

Assistance Feature: The App provides parental lock features (such as a lock PIN, or biometric authentication) intended to restrict children from leaving the drawing canvas, accessing the gallery, modifying settings, or sharing content.

Supplementary Tool: These parental controls are digital assistance tools and do not substitute for active adult supervision. Wonder Peddler does not guarantee that the lock mechanism is impenetrable.

Bypass Disclaimer: Wonder Peddler assumes no responsibility or liability for unauthorized access to settings, accidental deletion of files, or external sharing resulting from a child guessing a PIN, bypassing a lock, or accessing an unlocked device.

5. Purchases, Payments & Right of Withdrawal

One-Time Upfront Fee: Artly Ally is currently available via a one-time upfront purchase fee through the official platform stores: the Apple App Store and Google Play Store.

Future In-App Purchases: Wonder Peddler reserves the right to introduce optional in-app purchases (such as verified premium tracing packs) in future updates. These will be clearly labeled and require explicit authentication.

Platform Billing & Refunds: All payments, transactions, and refund requests are processed exclusively through Apple (App Store) or Google (Play Store) in accordance with their respective terms of service and refund policies. Wonder Peddler does not process or manage payments or direct refunds.

Waiver of EU Right of Withdrawal: If you are a resident of the European Union or United Kingdom, you acknowledge and agree that digital content is supplied immediately upon download, and by commencing download or use of the App, you expressly consent to immediate performance and waive any statutory 14-day right of withdrawal (cooling-off period) regarding digital content.

6. Third-Party Sharing & Peer-to-Peer Transmission

Peer-to-Peer Sharing: The App provides functionality to export drawings (such as PNG images or animated GIFs) and share tracing files peer-to-peer using native operating system share sheets (such as via messaging apps, email, or AirDrop).

Third-Party Platforms: Once content or files leave Artly Ally through your device's sharing tools, their transmission and storage are governed exclusively by the terms and privacy policies of the selected third-party service. Wonder Peddler has no control over, and disclaims all liability for, third-party communication channels or the security of transmitted media.

7. Intellectual Property & Limited License

App Ownership: All intellectual property rights, titles, and interests in and to Artly Ally, including its underlying software, code, algorithms, user interface, graphic designs, icons, trademarks, and documentation, are the exclusive property of Wonder Peddler and its licensors.

Limited License: We grant you a personal, non-exclusive, non-transferable, revocable, and non-sublicensable license to install and use the App on personal compatible devices for non-commercial, personal family or educational use, subject to these Terms.

Restrictions: You shall not decompile, reverse engineer, disassemble, modify, adapt, copy, distribute, sell, or create derivative works based upon the App or any portion thereof.

Dynamic Features and Service Modifications: Wonder Peddler reserves the right to modify, adjust, test, enable, or disable features dynamically through remote configuration or over-the-air parameters without prior notice, provided that such modifications do not eliminate the core functionality purchased.

8. Analytics, Operational Telemetry & Remote Configuration

Limited Technical Data: The App may collect limited, non-personally identifiable telemetry or aggregated operational analytics (such as feature usage events, e.g., drawing creation or export format selections) to help us troubleshoot errors, monitor app stability, and improve functionality.

Remote Configuration and Feature Flags: To maintain operational stability, optimize app performance, and test or deliver new capabilities, the App may utilize remote configuration services (such as Google Firebase Remote Config). These services securely retrieve technical parameters and feature flags over the network. They transmit only minimal technical metadata (such as operating system version, app build number, locale/language, and temporary app instance identifiers) and do not inspect, collect, or transmit your drawings, tracings, audio snippets, or personal identifying information.

9. Disclaimer of Warranties

"As Is" and "As Available": The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, statutory, or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted/error-free operation.

Device Compatibility: While we strive to maintain compatibility across supported iOS and Android devices, we do not warrant that the App will function seamlessly on every device model or operating system configuration.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Wonder Peddler, its founders, affiliates, directors, employees, or licensors be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages (including loss of data, device damage, loss of goodwill, or parental oversight issues) arising out of or related to your access to or use of (or inability to use) the App.

To the extent permitted by law, Wonder Peddler's total cumulative liability for any and all claims arising out of or related to these Terms or the App shall not exceed the total amount actually paid by you for the App during the twelve (12) months preceding the claim.

11. Governing Law & Dispute Resolution

Governing Law: These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of The Netherlands, without regard to conflict of law principles.

Jurisdiction: Any legal action, dispute, or proceeding arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Almere, The Netherlands, without prejudice to any mandatory consumer protection rights that grant you the right to bring proceedings in your country of residence under applicable local law.

12. Modifications to Terms

Wonder Peddler reserves the right to amend or update these Terms periodically to reflect changes in our App, legal requirements, or business practices.

The "Last Updated" date at the top of these Terms indicates when the latest revisions were made. Continued use of the App following any update constitutes your acceptance of the revised Terms.
